Terms of sale
Version of 6 October 2026. These terms are a translation provided for convenience; the French version prevails.
1. The seller
BROCS EN STOCK, SARL (limited company) with share capital of €1,000, registered office 7 rue Saint André, 57950 Montigny-lès-Metz, France, Metz Trade Register no. 794 032 417, EU VAT number FR72794032417. Shop: 25 quai Félix Maréchal, 57000 Metz, France. Contact: brocsenstock57000@gmail.com · +33 6 77 81 98 70.
2. Scope
These terms govern distance sales, through this website, of antique and second-hand objects to consumers. Placing an order implies acceptance of these terms, which are expressly accepted before the order is confirmed.
3. The pieces
Every piece is one of a kind and second-hand. Its description, photographs, condition and dimensions are presented with care and in good faith; signs of age and use inherent to an antique object are part of it and do not constitute a lack of conformity when they are described or visible in the photographs.
A piece added to the basket is reserved for the buyer for 20 minutes, extended while payment is in progress. Without payment, it becomes available to everyone again.
4. Prices
Prices are in euros, net: VAT not applicable, article 293 B of the French General Tax Code. Delivery costs depend on weight, destination and method; they are displayed before the order is confirmed. The price paid is the one shown in the order review at the time of ordering.
5. Ordering
Ordering takes four steps: basket, details and delivery method, review, payment. The review lets the buyer check and correct the order before confirming it with the “Order with obligation to pay” button.
The contract is formed upon confirmation of payment by our payment provider. A confirmation e-mail containing the order, these terms and the withdrawal form is then sent to the buyer, with the personal link to the order.
If, when payment is confirmed, a piece in the order is no longer available (sold in the shop in the meantime), the order is cancelled in full and refunded entirely, immediately, and the buyer is informed by e-mail.
6. Payment
Payment is made by card (and Apple Pay or Google Pay) when ordering, through Stripe. Card details never pass through our servers. The buyer’s bank may require strong authentication (3-D Secure).
7. Delivery and collection
Methods: Colissimo home delivery (France), Mondial Relay pick-up point (France), Colissimo International, or free collection from the shop. Methods depend on country and weight. Above €150 of goods, delivery in France is signed for.
Times: dispatch within 3 working days after payment is confirmed; indicative transit times of 2 to 5 working days in France. In any event, delivery takes place no later than 30 days after the order.
Outside the European Union, import duties and taxes may be charged on delivery; they are paid by the buyer.
Collection from the shop: the piece is kept for 15 days after the notice of availability, during opening hours.
The risk of loss or damage passes to the buyer when they take physical possession of the piece (article L. 216-4 of the French Consumer Code). In case of visible damage, the buyer should record reservations with the carrier and inform us promptly, with photographs.
8. Right of withdrawal and returns
Legal right. The buyer has fourteen days from receipt of the piece to withdraw, without giving any reason (article L. 221-18 of the French Consumer Code).
Our commitment. This period is extended to thirty days from receipt, and return costs are paid by us.
How to withdraw. The simplest way: the “Withdraw from the contract here” button on the order page, available from the confirmation e-mail throughout the period; an acknowledgement is sent immediately. The buyer may also send us the form below, or any other unambiguous statement, by e-mail or post.
Return. The piece must be sent back within fourteen days of communicating the decision, carefully packed, to the address given in the acknowledgement. Return costs incurred are reimbursed on proof.
Refund. We refund the price of the piece, the original delivery costs (up to the least expensive standard delivery) and the return costs, no later than fourteen days after being informed of the decision; the refund may be withheld until the piece is received back. It is made using the original means of payment. The buyer may be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the piece (article L. 221-23).
9. Legal guarantees
The consumer has two years from delivery of the goods to claim the legal guarantee of conformity if a lack of conformity appears. For second-hand goods, for twelve months from delivery, the consumer only needs to establish the existence of the lack of conformity, not the date it appeared.
The legal guarantee of conformity entitles the consumer to repair or replacement within thirty days of the request, free of charge and without major inconvenience. Since each piece is unique, replacement is in practice impossible. If the goods are repaired under the guarantee, the consumer benefits from a six-month extension of the original guarantee.
The consumer may obtain a price reduction while keeping the goods, or terminate the contract with a full refund against return of the goods, if: the seller refuses to repair or replace; repair or replacement takes more than thirty days; it causes major inconvenience; or the lack of conformity persists despite the seller’s attempt. The consumer is also entitled to an immediate price reduction or termination when the lack of conformity is serious enough to justify it, but not to termination when it is minor. Any period during which the goods are immobilised for repair suspends the remaining guarantee.
These rights derive from articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who in bad faith obstructs the legal guarantee of conformity incurs a civil fine of up to €300,000, which may be raised to 10% of average annual turnover (article L. 241-5).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect, giving the right to a price reduction if the goods are kept, or a full refund against their return.
10. Personal data
Data collected when ordering is used solely to fulfil the order and meet the related legal obligations. Processing is described in our privacy policy.

12. Governing law
These terms are governed by French law. They are written in French; in case of discrepancy with a translation, the French version prevails.
